Once we receive your notification, we will allocate a dedicated claims handler to you who will be your point of contact until the conclusion of the claim.

Professional negligence claims

If the claim is in the pre-action stage, your claims handler will take a view on the merits and then recommend a strategy for dealing with the claim. Depending on the merits, the claim will either be settled on the best available terms or robustly defended. You will be consulted at all stages of the process and kept informed of developments as and when they arise.

Once proceedings are issued Bar Mutual will instruct solicitors (and, as necessary, counsel) to conduct the claim on your behalf.  You will be consulted on the choice of solicitors and counsel, but the decision on whom to instruct is ultimately that of Bar Mutual.

Complaints to the Bar Standards Board

If the Bar Standards Board has written to you asking for your comments on a disciplinary complaint made to them, we offer guidance and advice on the best way to structure your response. We are experienced in dealing with the Bar Standards Board and would ask Members to bear in mind that both the content and the tone of their response will play a key role in determining whether or not the Bar Standards Board decides to take the matter further.

If the complaint is not dismissed at a preliminary stage and the Bar Standards Board decides to prosecute you for professional misconduct, Bar Mutual will instruct solicitors and counsel to represent you at the disciplinary hearing. Your claims handler will consult you on the choice of solicitors (and counsel), but the decision on whom to instruct is that of the claims handler.
